A contract must be performed according to its terms and in a manner consistent with good faith.1 By approving the four variation orders in writing, the respondent accepted the varied works and is bound to pay for them.

The delay-penalty clause does not stand alone. The court may adjust agreed compensation so that it equals the actual loss,2 and the respondent has shown none.
